Terms of Use

• The app is provided by TRASHTREK APP, razvoj sodobnih tehnologij, d.o.o., Ulica škofa Maksimilijana Držečnika 6, 2000 Maribor, Slovenija; registration number 7449887000, tax number 62670450 ("TrashTrek", "we").
• Single point of contact for users and authorities (Articles 11 and 12 of the Digital Services Act): info@trashtrekapp.com. We communicate in Slovenian and English.

• TrashTrek is a community for a cleaner environment. You can report polluted spots, log cleanups, earn points and join organized cleanup events. The app is free to use.
• The app is under development. We may change, add or remove features; we will tell you about material changes.

• You must be at least 16 years old. You confirm this when you create an account.
• You may have one account. The details you give must be true. Your username must not be offensive, misleading or impersonate another person or organization.
• You are responsible for keeping your password and device secure. If you suspect misuse of your account, email us right away.

• Only post photos of litter, polluted spots and cleanups that you took yourself.
• Photos must not show recognizable people, licence plates, house numbers or other personal details.
• Do not accuse identifiable people, companies or landowners of polluting. Describe the situation, not the culprit. Report suspected offences to the authorities (for example the inspectorate or police), not in the app.
• The location and description of a report must be true; deliberately false reports are not allowed.
• Illegal, offensive, violent, sexual, discriminatory or otherwise inappropriate content, advertising, spam and infringing the rights of others (for example copyright or privacy) are not allowed.
• Do not enter private or closed land without permission to take photos.

• A human moderator reviews reports and cleanups against these rules before they become public. We do not use automated tools to decide on content.
• We may reject or remove content that breaks the rules or the law. Serious or repeated violations can lead to a temporary or permanent suspension of the account, taking into account the severity, frequency and intent of the violation.
• When we reject or remove content or restrict an account, we tell you and give the reason, unless the law prevents it.

• In the app, you can report a post or a user with the "⋯" button (Report post, Report user) and choose a reason. You can also block a user whose posts you no longer want to see; unblock them in your profile settings.
• Anyone without an account can also report content to info@trashtrekapp.com. Say which content it is (a link, or the location and date), why you believe it is illegal or breaks the rules, your name and email address, and a statement that you believe the information is accurate. Reports of child sexual abuse do not need a name.
• We confirm receipt, handle the report carefully, objectively and without undue delay, and tell you our decision. Requests to remove photos showing a recognizable person or their property are handled with priority.

If you disagree with our decision about content or an account (or about your report), you can appeal within 6 months by emailing info@trashtrekapp.com. The appeal is reviewed by a different person than the one who made the decision. You also have the right to go to court.

• You keep the copyright in your photos and texts.
• By posting, you grant us a non-exclusive, free, worldwide licence to store, adapt (for example compress or crop) and publicly show the content in the app, on the map and when presenting the impact of the TrashTrek community (for example statistics and reports to partners), without naming you.
• The licence lasts while the content is published. When you delete your account, your approved reports and cleanups stay anonymized (with no link to you) and the licence for that anonymized content continues so the map stays useful. If you want a specific anonymized item removed too, email us.
• You confirm that you have the rights to the content you post and that it does not infringe the rights of others.

• Points, badges and leaderboards are part of the in-app game and have no monetary value. They cannot be exchanged for money or transferred. A moderator awards points when a report or cleanup is approved; points earned unfairly can be removed.
• If we ever offer prizes or contests, separate rules will apply to them.

• You clean up voluntarily and at your own risk. Wear gloves and suitable shoes, and watch out for traffic, water, steep ground and the weather.
• Do not touch hazardous waste (needles, sharp objects, chemicals, asbestos, batteries, dead animals, large dumps). Report it to the local utility service or the inspectorate.
• Dispose of collected waste according to the rules and the instructions of your local utility service.

• TrashTrek or our partners may organize group cleanups. Each event lists its organizer, place, time and instructions in the app or the invitation. If a partner organizes an event, the partner is the organizer and responsible for running it.
• The organizer gives safety instructions before the start, provides protective equipment where needed and arranges the removal of collected waste. Participants must follow the organizer's instructions.
• Minors (under 18) may only take part with the consent and in the company of a parent, guardian or responsible adult (for example a teacher or mentor) who looks after them for the whole event.
• Participation is voluntary. Participants are not covered by accident insurance through the organizer unless this is stated explicitly; we recommend your own accident insurance.
• The organizer may postpone or cancel an event because of the weather or for safety reasons. Photos may be taken during events; if you do not want to appear in them, tell the organizer.

• We provide the app as it is, without a guarantee that it works without interruption or that content posted by users is complete or accurate. We are not liable for user content until we learn that it is illegal; once we do, we act quickly.
• TrashTrek's liability for damage is excluded to the extent permitted by law. This does not apply to damage caused intentionally or through gross negligence, or to injury to life, body or health, where we are liable as provided by law.
• You are responsible for the content you post and for your conduct during cleanups and events.

• You can delete your account at any time in the app (Profile → Delete account) or by email. This ends the agreement. What happens to your data is described in the Privacy Policy.
• We may also end the agreement with at least 30 days' notice, or immediately in case of a serious breach of these terms.

We may change these terms, for example because of new features or changes in the law. We tell you about material changes in the app in advance and ask you to accept them again. If you do not agree, you can delete your account at any time.

• These terms do not limit the rights you have as a consumer under the law.
• These terms are governed by the law of the Republic of Slovenia. For consumers this does not remove the protection of the mandatory rules of the country where they live.
• We try to settle disputes amicably first; email us at info@trashtrekapp.com. If we cannot, the competent court in Maribor has jurisdiction; consumers may also sue in the court of their place of residence.
